Neighbor Law
Neighbor law encompasses a wide variety of legal issues, all related to the interactions of those living near each other, and the rights and responsibilities of one neighbor to another. These issues include trespassing, positioning of fences, boundary line disputes, hedges, trees with overhanging branches and encroaching roots, drainage and property boundary matters. In addition, it includes "nuisance abatement" matters such as sound, light, smell, smoke, dust or even barbeque. Poorly built or unfinished buildings that pose hazards to children in the area are also an issue of contention between neighbors that may be the basis for a complaint.
Since most neighbor law issues have to do with property, and property is considered "unique" under the law, more than money damages may be at stake in these cases. Frequently, plaintiffs are able to obtain a court order that demands the condition or nuisance be corrected. Trees and shrubs that cross property lines or endanger people may be removed by order of the court. Boundary line disputes may require trees be replanted depending on the outcome of the case. Finally, dangerous instrumentalities, such as trees that reach to power lines and may be climbed by children may need to be trimmed, or cut down, depending on the situation
